Terms and Conditions

1. Applicability

These terms and conditions apply to all quotations, agreements and services provided by Kosify, unless otherwise agreed in writing.

By using our services or accepting a quotation, the client agrees to these terms and conditions.

These terms and conditions take precedence over any terms of the client, unless explicitly agreed otherwise in writing.

2. Services

Kosify provides digital services, including but not limited to:

  • websites and online stores
  • maintenance and support
  • software and AI solutions
  • digital consulting and guidance

The exact content, scope and terms of the services are always set out in a quotation or agreement.

3. Quotations and agreements

Quotations are non-binding and valid for the period stated in them.

An agreement is concluded after written confirmation by the client (by email or signature).

Changes, extensions or additional requests not included in the original quotation will be discussed separately and may result in additional costs.

4. Client responsibilities

The client is responsible for:

  • providing accurate, complete and up-to-date information
  • the content (text, images and data) placed on the website, online store or application
  • complying with all legal and regulatory obligations applicable to their business

Kosify is not responsible for inaccurate or incomplete information supplied by the client.

5. Privacy, GDPR and legal information

Kosify provides technical and digital services.

Any information provided by Kosify about privacy, cookies, data processing or the GDPR is provided solely from a technical perspective (for example, which scripts, cookies or features are technically present on a website).

This information does not constitute legal advice.

The client expressly acknowledges that:

  • Kosify is not a legal adviser
  • Kosify is not the data controller for personal data processed by or on behalf of the client

The client remains responsible at all times for:

  • the content and legal accuracy of privacy policies, cookie policies and terms and conditions
  • compliance with the GDPR and other applicable legislation

For legal advice, we recommend consulting a specialised adviser or service provider, such as a lawyer or social secretariat.

6. Maintenance and support

If maintenance or support is provided:

  • it is provided in accordance with the arrangements set out in the agreement or quotation
  • the client may terminate the collaboration in accordance with the agreed terms
  • Kosify is not responsible for issues caused by updates, changes or outages affecting external platforms, software, plugins or third-party services

7. Liability

Kosify undertakes to perform its services with reasonable care and professionalism.

To the extent permitted by law, Kosify’s liability is in all cases limited to:

  • the amount paid for the service to which the liability relates

Kosify is not liable for:

  • indirect damage
  • consequential damage
  • loss of revenue, profit or data
  • damage caused by third parties or external services

8. Force majeure

Kosify cannot be held liable if performance of the agreement is prevented in whole or in part by circumstances beyond its control, including but not limited to:

  • technical failures
  • network issues
  • government measures
  • outages or failures affecting external suppliers or service providers

9. Termination

Either party may terminate the agreement in accordance with the terms set out in the agreement or quotation.

Upon termination, services already performed and costs already incurred remain payable.

10. Governing law and competent court

All agreements and disputes are governed by Belgian law.

In the event of a dispute, only the courts of the judicial district in which Kosify is established have jurisdiction.

11. Changes

Kosify reserves the right to amend these terms and conditions.

The most recent version is always available on the website and applies to new quotations and agreements.
